Welcome to Artwork Identifier, an AI-powered artwork identification application ("App") developed by Asil Arslan ("Developer", "we", "us", or "our"). These Terms of Use ("Terms") govern your use of our App and services.

1. Acceptance of Terms

By downloading, installing, or using Artwork Identifier, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Description of Service

Artwork Identifier is an educational application that uses artificial intelligence to help identify artworks based on images. The App provides:

• AI-powered artwork recognition technology
• Artist information and art history details
• Educational content about art movements and styles
• Historical context and cultural significance information
• Interactive learning features and quizzes
• Premium features through subscription services

3. Subscription Terms

3.1 Premium Subscription

Artwork Identifier offers premium features through subscription plans:

• Weekly Plan (3-Day Trial): ₺199,99
• Annual Plan: ₺999,99

Subscription prices may vary by region and are subject to change. Please check the App Store or Google Play Store for current pricing in your location.

3.2 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Cancellation

You can manage and cancel your subscriptions by going to your Account Settings in the App Store (iOS) or Google Play Store (Android) after purchase. Cancellation will take effect at the end of the current billing cycle.

3.4 Free Trial

Some subscription plans may offer a free trial period. If you cancel during the trial period, you will not be charged. If you do not cancel, your subscription will automatically begin and you will be charged.

4. User Conduct

You agree to use Artwork Identifier only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any commercial purpose without our consent
• Attempt to reverse engineer, decompile, or disassemble the App
• Upload inappropriate, offensive, or copyrighted content
• Interfere with or disrupt the App's functionality
• Use the App in any way that violates applicable laws or regulations
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

5. Intellectual Property Rights

Artwork Identifier and all its content, features, and functionality are owned by Asil Arslan and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without explicit written permission.

All artwork images, artist information, and educational content provided by the App are for educational and informational purposes only. Any use of such content for commercial purposes may require additional permissions from the respective copyright holders.

6. Accuracy and Limitations

While we strive for accuracy, Artwork Identifier's AI identification results are provided for educational and informational purposes only. We do not guarantee:

• 100% accuracy of artwork identification
• Completeness of artwork or artist information
• Suitability for professional authentication purposes
• Accuracy of historical context or cultural information

Users should always consult professional art experts, museum curators, or certified appraisers for official authentication, valuation, and scholarly research purposes.

7. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use our App. The Privacy Policy is incorporated into these Terms by reference.

8. Disclaimer of Warranties

Artwork Identifier is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, secure, error-free, or that any defects will be corrected. We are not responsible for the accuracy, completeness, or usefulness of any information provided by the App.

9. Limitation of Liability

To the maximum extent permitted by law, Asil Arslan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

In no event shall our total liability to you for all damages exceed the amount you paid for the App or subscription in the twelve (12) months prior to the action giving rise to liability, or one hundred dollars ($100), whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless Asil Arslan from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of Artwork Identifier or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App, by email (if provided), or by updating the "Last Updated" date at the top of this page. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to Artwork Identifier at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be interpreted and governed by the laws of Turkey, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Turkey.

14. App Store Terms

14.1 Apple App Store

If you downloaded Artwork Identifier from the Apple App Store, you acknowledge that these Terms are between you and Asil Arslan only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance and support services with respect to the App.

14.2 Google Play Store

If you downloaded Artwork Identifier from the Google Play Store, you acknowledge that these Terms are between you and Asil Arslan only, not with Google LLC. Google is not responsible for the App or its content.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Asil Arslan regarding the use of Artwork Identifier and supersede all prior agreements and understandings.
